The National Institute of Trial Lawyers is an invitation only professional organization composed of premier trial lawyers from each state. These lawyers exemplify the very best qualities and qualifications of a lawyer.

What Situations Commonly Lead to Encounters with Law Enforcement?
Driving, walking, and being accused of a crime are the most common encounters people have with law enforcement. Cases commonly called Driving While Intoxicated (DUI); in Indiana, it is called Operating a Vehicle While Intoxicated (OVWI). It does not take much to think of examples of someone driving while under the influence of drugs or alcohol.
Police are always alert for those types of drivers. Intoxicated drivers are usually easy to spot, making them a prime target for law enforcement encounters.
Of course, the police consistently encounter people that drive over the speed limit, do not signal a turn within 200 feet, or engage in other traffic violations. Once the police stop you, if they smell the odor of marijuana or see drugs in plain view in your vehicle, then they can ask you to step out of the car while they search it. If you illegally possess drugs, then your day goes from bad to worse.
As you can see, there is a similarity between encounters with law enforcement in prison and on the street. A similar issue is a search. Getting searched by the police can lead to some unfortunate circumstances. One reason that interactions between African- Americans and police are tense is that both parties are scared. The bottom line is that although officers may be well-trained, most of them are scared. Most police will not admit to being scared, but they are, and it is understandable. They have heard stories of encounters with civilians that ended in the officer getting killed. If you are an African- American, you might also be scared because you have heard of so many encounters between police and African-Americans. The Black man ends up being killed by the police in your story. The police officer is the one who gets killed by the Black man in their story.
In many areas—especially in low-income African-American communities—the police patrol the streets and then stop people they see on the road. Sometimes it may not be consensual, but the officer will justify the stop as a consensual Terry stop encounter.
A Terry stop is also known as a stop and frisk search. The Terry stop name is from the U.S. Supreme Court case called Terry v. Ohio, 392 U.S. 1 (1968). Basically, a Terry stop is when a police officer has a reasonable suspicion that an individual is armed, engaged, or about to be involved in criminal conduct. The officer may then briefly stop and detain an individual for a pat-down search (frisk) of outer clothing. A Terry stop is a seizure within the meaning of the Fourth Amendment of the United States Constitution.

If you are charged with a crime and have a jury trial, you might wonder what the steps are. The process starts when the prosecution and defense teams present their cases. The court clerk will call groups of prospective jurors for voir dire. The judge will also ask each potential juror to answer questions that will help them decide if they are impartial. A judge will explain the legal standard based on the charges and evidence. Once a jury has been selected, they will be instructed by the judge to decide the case.
The parties give opening statements, direct examination and cross-examination of witnesses, then closing arguments. After the closing arguments, the judge will give the jury instructions.
